Who We Are

These Terms of Service (“Terms”) govern your access to and use of SCADA & Beyond with Alana, a Substack publication (the “Publication”), including all newsletter content, podcast episodes, community features, and subscriber-exclusive materials (collectively, “Content”). The Publication is operated by Alana Murray (“we,” “us,” “our”).

By subscribing to, accessing, or using the Publication, you agree to these Terms.

1. Scope of Services & Educational Purpose (No Professional Advice)

Our Content is educational and informational. It provides general guidance based on industry experience and is not engineering, legal, or professional advice for any specific project, facility, or system.

You are responsible for your own decisions and outcomes.

  • You must consult qualified engineers, system integrators, and relevant authorities before design, selection, or implementation of any operational technology, industrial control system, or related infrastructure.

  • You must ensure compliance with all applicable codes, standards, and regulations in your jurisdiction.

  • Nothing in this Publication constitutes professional engineering services, stamped designs, or regulatory submissions.

2. Subscription Tiers & Access

The Publication offers both free and paid subscription tiers:

  • Free Subscribers receive selected posts, including “Snapshots” and other public content.

  • Paid Subscribers (“Insiders”) receive all free content plus exclusive “Insider” posts, downloadable resources (the “Insider Vault”), access to monthly Q&A threads, and other subscriber-only features as offered.

Access to paid Content requires an active paid subscription in good standing.

3. Accounts & Eligibility

You must be of legal age to form a contract in your jurisdiction to subscribe. You are responsible for maintaining the security of your account credentials and for all activities under your account.

Your subscription account is managed through Substack. By subscribing, you also agree to Substack’s Terms of Use (https://substack.com/tos).

4. Payments, Pricing & Billing

All payments are processed by Substack using Stripe. We do not directly collect or store your payment information.

  • Subscription pricing is displayed at the time of purchase and may change for future billing cycles with reasonable notice.

  • You are responsible for any applicable taxes.

  • Billing occurs on a recurring basis (monthly or annually) depending on your selected plan.

  • You may cancel your subscription at any time through your Substack account settings. Cancellation stops future billing but does not provide a refund for the current billing period unless required by law or Substack’s policies.

5. Content Delivery

Content is delivered electronically via:

  • Email to your registered address

  • The Substack website and mobile app

  • Podcast feeds (for audio content)

Delivery depends on Substack’s infrastructure. We are not responsible for delays or failures caused by Substack outages, email filtering, or your device/network settings.

6. License to Use (What You May Do)

Upon subscription, we grant you a limited, revocable, non-exclusive, non-transferable, personal license to:

  • Read, listen to, and download Content for your own personal learning and professional development

  • Use downloadable resources from the Insider Vault as personal reference materials for your own learning and professional development

  • Share brief excerpts (with attribution) in accordance with fair use principles

This license is for your individual use only. Sharing login credentials or systematically distributing paid Content to non-subscribers is prohibited.

7. Prohibited Uses (What You May Not Do)

Unless you have our prior written permission, you may not:

  • Forward, repost, publish, sell, or redistribute paid Content to non-subscribers

  • Share your subscription login credentials with others

  • Scrape, bulk-download, or systematically copy Content

  • Use Content to create competing products, courses, or publications

  • Use Content to train AI models or machine learning systems

  • Remove disclaimers, attribution statements, or proprietary notices from any materials

  • Misrepresent Content as “certified,” “approved,” “validated,” or as an official “standard” or “specification”

  • Represent that professional engineering services, system designs, or regulatory submissions are based on, derived from, or validated by our materials

8. Attribution

If you publicly reference or quote Content (e.g., in presentations, articles, or social media), please include: “Source: SCADA & Beyond with Alana” or a link to the Publication.

9. Intellectual Property

All Content—including text, graphics, audio, templates, frameworks, and methodologies—is our intellectual property, protected by copyright and other applicable laws.

Your subscription grants a license to use Content as described above. No ownership or intellectual property rights transfer to you.

10. Community Guidelines

The Publication may include community features such as comments, discussion threads, and restacks. By participating, you agree to:

  • Engage respectfully and professionally

  • Refrain from spam, harassment, hate speech, or promotional content unrelated to discussion topics

  • Respect the privacy and confidentiality of other community members

We reserve the right to remove comments or restrict community access for violations of these guidelines.

11. Third-Party Services

The Publication operates on Substack’s platform, which provides hosting, payment processing, email delivery, and other infrastructure. Substack operates under its own Terms of Use (https://substack.com/tos) and Privacy Policy (https://substack.com/privacy).

We may link to third-party websites, tools, or resources. We are not responsible for third-party content, availability, or practices.

12. Refunds & Cancellation

Refund eligibility is governed by Substack’s policies. Generally:

  • You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period.

  • Refund requests should be directed to Substack support.

We may offer discretionary refunds in limited circumstances but are not obligated to do so.

13. Availability & Changes

We may modify, pause, or discontinue any Content, features, or subscription tiers at any time. We will make reasonable efforts to notify paid subscribers of material changes affecting their subscription benefits.

14. Feedback

If you submit ideas, suggestions, or feedback, you grant us a non-exclusive, worldwide, royalty-free license to use them without restriction or compensation.

15. No Warranty (AS IS)

To the fullest extent permitted by law, the Publication and Content are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that Content will meet your specific requirements, be error-free, or be available without interruption.

16. Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability for any claim arising from the Publication or Content will not exceed the subscription fees you paid in the 12 months preceding the claim.

  • We are not liable for indirect, consequential, incidental, special, exemplary, or punitive damages, including loss of profits, data, goodwill, or business interruption.

  • We are not liable for any damages arising from your use or implementation of information, frameworks, or guidance from the Publication.

Some jurisdictions do not allow certain limitations; in those cases, the above applies to the maximum extent permitted by law.

17. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your misuse of Content

  • Your violation of these Terms

  • Your implementation of any information from the Publication

  • Any infringement of third-party rights

18. Governing Law & Venue

These Terms are governed by the laws of Nova Scotia, Canada, without regard to conflict-of-laws principles. You consent to the exclusive jurisdiction and venue of the provincial and federal courts located in Nova Scotia for any dispute not resolved informally.

19. Termination

We may suspend or terminate your access to the Publication if you violate these Terms. Upon termination, your license to use Content ends, and you must cease use of and delete any downloaded materials, except for materials already incorporated into personal notes or reference materials created before termination.

20. Privacy

Your use of the Publication is also governed by our Privacy Policy scadaandbeyond.substack.com/privacy and Substack’s Privacy Policy. Please review both to understand how personal information is collected and processed.

21. Changes to These Terms

We may update these Terms periodically. The “Last Updated” date indicates the current version. Material changes will be communicated via the Publication or email. Continued use after changes constitutes acceptance of the revised Terms.

22. Miscellaneous

  • No Waiver. Failure to enforce any provision is not a waiver of that provision.

  • Severability. If any provision is unenforceable, the remaining provisions remain in effect.

  • Assignment. You may not assign your subscription or these Terms without our consent. We may assign them as part of a business reorganization or sale.

  • Entire Agreement. These Terms, along with referenced policies, constitute the entire agreement regarding your use of the Publication.
